Credit Card Billing Error: the call script

This is the dispute with the strongest federal backing: the law spells out your exact rights, deadlines, and the issuer's obligations.

Know your rights (plain English)

  • 60-day dispute window — You have 60 days from the statement date to dispute a billing error in writing. The issuer must acknowledge within 30 days and resolve within two billing cycles. (Fair Credit Billing Act)
  • Withhold the disputed amount — While the dispute is investigated, you may withhold payment on the disputed amount (keep paying the rest of your bill). (Fair Credit Billing Act)
  • $50 max liability — Your liability for unauthorized charges is capped at $50 — and most issuers waive even that. (Truth in Lending Act)
  • No retaliation — The issuer can't close your account or report you delinquent over the disputed amount during the investigation. (Fair Credit Billing Act)

The call script

Opening line
"Hi, I'm disputing a billing error on my statement dated [DATE], card ending [XXXX]: a $[AMOUNT] charge from [MERCHANT] on [DATE]."
1. State it's a billing error
"Say: 'I'm disputing this as a billing error under the Fair Credit Billing Act. The charge is [wrong amount / for goods never received / unauthorized].'"
2. Insist on written dispute
"Say: 'I'll also send this in writing today — but please open the dispute now and give me a case number.'"
3. Confirm protections
"Ask: 'Please confirm I won't be charged interest on the disputed amount during the investigation, and that my account stays in good standing.'"

When they push back

They say: "You need to resolve this with the merchant first."
You say: "I've tried — and the law gives me the right to dispute directly with you within 60 days. Please open the dispute now."
They say: "It's past the deadline."
You say: "My statement is dated [DATE], which is within 60 days. Please check again and open the case."
They say: "We'll note it but can't guarantee an outcome."
You say: "I understand — please give me the case number and confirm the investigation timeline in writing."
They say: "You still have to pay the full balance."
You say: "The law lets me withhold the disputed $[AMOUNT] during the investigation. I'll pay the rest of the balance in full."

Before you call — documentation checklist

  • Statement showing the error (circle it)
  • Receipts / order confirmations proving the error
