Landlord Security Deposit: the call script

Deposits are your money held in trust, not a landlord bonus. Most states set strict return deadlines — and penalties for landlords who stall.

Know your rights (plain English)

  • Return deadlines — Most states require landlords to return your deposit within a set time after move-out — commonly 14 to 60 days — along with an itemized list of any deductions. (State security-deposit statutes)
  • Bad-faith penalties — Many states let tenants recover 2–3 times the deposit when a landlord withholds it in bad faith. Mentioning this politely gets attention. (State security-deposit statutes)
  • Normal wear vs damage — Landlords generally can't charge for normal wear and tear — only actual damage beyond ordinary use. (State law (majority rule))
  • Small claims court — Deposit disputes are the classic small-claims case: cheap to file, no lawyer needed, and landlords often settle once served. (State court systems)

The call script

Opening line
"Hi, I'm calling about my security deposit of $[AMOUNT] for [ADDRESS]. I moved out on [DATE] and haven't received it or an itemized deduction list."
1. State the deadline
"Say: 'My state requires return within [X] days of move-out with an itemized list. That deadline was [DATE].'"
2. Challenge deductions
"For each deduction: 'Can you explain this charge? That looks like normal wear and tear, which isn't chargeable.'"
3. Mention the penalty calmly
"Say: 'I'd prefer to resolve this between us — but my state allows [2x/3x] damages for bad-faith withholding, so I'd like this settled this week.'"

When they push back

They say: "We're still processing it."
You say: "The statutory deadline was [DATE]. Please send the deposit plus itemized deductions by [DATE 7 days out], or I'll file in small claims court."
They say: "The cleaning cost $400."
You say: "Please send me the paid cleaning invoice and the move-in/move-out inspection reports showing the unit's condition."
They say: "You damaged the carpet."
You say: "I have move-in and move-out photos showing [condition]. Normal wear isn't chargeable — please remove that deduction."
They say: "Talk to the property manager."
You say: "Please give me their direct contact. I'll also send a written demand today so the timeline is documented."

Before you call — documentation checklist

  • Move-in and move-out photos
  • Your lease (deposit clause)
  • Move-out inspection report (if any)
  • Dates: lease end + forwarding address proof
  • Your state's deposit deadline and penalty multiple (quick search)
  • Small claims court filing info as backup

After the call — follow-up email

Copy, fill in the brackets, send. This creates the paper trail.

Subject: Demand: return of security deposit — [ADDRESS] Hello, I moved out of [ADDRESS] on [DATE] and provided a forwarding address. My security deposit was $[AMOUNT]. I demand: (1) full return of $[AMOUNT] (or the undisputed portion plus an itemized list), sent to [FORWARDING ADDRESS] within 7 days; (2) copies of any invoices for claimed deductions. If unresolved, I'll file in small claims court, where my state allows up to [2x/3x] damages for bad-faith withholding. [YOUR NAME] [PHONE]
