Rental Car Damage Claim: the call script

Damage claims arrive weeks later with shocking invoices. You owe only for real damage beyond normal wear — and they have to prove it.

Know your rights (plain English)

  • Burden of proof is theirs — The rental company must show the damage is real, beyond normal wear, and actually repaired — ask for timestamped photos and the repair invoice. (Contract principles)
  • Credit card coverage — Many credit cards include rental-car damage coverage when you pay with the card — check your card's benefits guide before paying anything. (Card benefit terms)
  • Don't admit on the spot — Anything you say at the counter can be used in the claim. 'I'll review this in writing' is always a safe answer. (General guidance)

The call script

Opening line
"Hi, I'm calling about a damage claim on rental agreement [NUMBER], vehicle returned on [DATE]. I'd like to see the evidence before discussing payment."
1. Demand evidence
"Say: 'Please send me timestamped photos of the damage at return, the pre-rental inspection report, and the actual repair invoice.'"
2. Question the amount
"Ask: 'Was the car actually repaired? Can I see the paid invoice — not an estimate? What about loss-of-use documentation?'"
3. Invoke card coverage
"Say: 'I paid with a credit card that includes rental coverage — I'll be filing with them. Please send everything to me in writing.'"

When they push back

They say: "You signed accepting responsibility."
You say: "I signed a rental agreement, not an admission of this specific damage. Please send the evidence I requested."
They say: "The charge is already on your card."
You say: "I'm disputing that charge with my card issuer until I receive photos, the inspection report, and a paid repair invoice."
They say: "Our estimate is $2,400."
You say: "An estimate isn't a paid invoice. Please confirm whether the repair was actually performed and send the final invoice."
They say: "This is standard procedure."
You say: "Then standard procedure should include sending me the documentation. My email is [EMAIL] — I'll await it before any further discussion."

Before you call — documentation checklist

  • Rental agreement number
  • Pre-rental inspection photos (yours, if taken)
  • The damage claim letter
  • Your credit card's rental-coverage benefit terms
  • All correspondence in writing

After the call — follow-up email

Copy, fill in the brackets, send. This creates the paper trail.
